IMPORTANT: All songs are generated using artificial intelligence. By using our service, you acknowledge and agree that:

• AI-generated content may contain fictionalized, imperfect, or inaccurate information
• Songs are created based on your input but may not perfectly match your expectations
• We are NOT liable for emotional reactions, misinterpretations, jokes, or any content within generated songs
• Output quality may vary as this is an early-access product under continuous improvement
• Songs are NOT intended for medical, legal, professional, or therapeutic advice of any kind

3. User Responsibilities

By using ShoutoutSong, you confirm and agree that:

• You have the right and permission to submit the names and personal details of any individuals referenced in your song requests
• You will NOT use the service to harass, defame, threaten, or harm others
• You will NOT request content that is illegal, obscene, hateful, or violates third-party rights
• You are at least 13 years old (or have parental consent if under 18)
• You will NOT attempt to reverse-engineer, exploit, or abuse our service

4. Intellectual Property & Content Ownership

Original AI-Generated Works: All songs created by ShoutoutSong are original AI-generated works and do not contain copyrighted melodies or lyrics from third parties.

Your Rights: You retain rights to use, share, and distribute songs you've purchased for personal, non-commercial purposes.

Our Rights: ShoutoutSong retains rights to:

• Use anonymized data from generated songs for service improvement and AI training
• Display generated songs for marketing purposes (with user permission)
• Modify or discontinue features at any time

You may NOT:

• Resell or commercially distribute songs without explicit written permission
• Claim songs as entirely your own original creation
• Use songs in ways that violate applicable laws or third-party rights

5. Payment & Purchases

• All purchases are processed securely through Stripe
• Prices are clearly displayed before purchase
• Payment is required before accessing full-quality song downloads
• All sales are final unless covered by our Refund Policy

6. Service Availability

We strive to provide reliable service but do NOT guarantee:

• Uninterrupted or error-free operation
• That all songs will generate successfully
• Specific generation times (though we aim for ~1 minute)
• Permanent storage of your songs (download and save locally)

7. Prohibited Uses

You may NOT use ShoutoutSong to:

• Create content that harasses, bullies, or threatens individuals
• Generate songs containing hate speech, discrimination, or violence
• Impersonate others or misrepresent relationships
• Violate any local, state, national, or international law
• Infringe on intellectual property rights of others
• Create sexually explicit content involving minors
• Spread misinformation or harmful content

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• ShoutoutSong is provided "AS IS" without warranties of any kind
• We are NOT liable for any indirect, incidental, consequential, or punitive damages
• Our total liability for any claim is limited to the amount you paid for the specific song in question
• We are NOT responsible for how you or others use, share, or react to generated songs

9. Indemnification

You agree to indemnify and hold harmless ShoutoutSong, its owners, and service providers from any claims, damages, or expenses arising from:

• Your use of the service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you submit or songs you share

10. Termination

We reserve the right to:

• Refuse service to anyone for any reason
• Terminate or suspend access for violations of these Terms
• Remove content that violates our policies
• Modify or discontinue the service at any time

11. Changes to Terms

12. Governing Law

These Terms are governed by the laws of the State of Nebraska, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Omaha, Nebraska.
